CHECK THE FACTS

May 501(c)(3) public charities influence the confirmation of Supreme Court nominees?

Yes! The Internal Revenue Service has recognized that influencing the confirmation of federal judges is exactly like influencing any other legislative vote through lobbying. “Because the Senate’s action of advice and consent on a judicial nomination is an action with respect to a resolution or similar item, the Senate’s confirmation vote constitutes a vote on legislation.” (IRS Notice 88-76, 1988-2 C.B. 392.)

DOES THE GIFT TAX APPLY TO YOU?

Tax-exempt organizations and their donors should be aware that some gifts (both money and property) to certain nonprofits may be subject to the federal gift tax.

In most cases, however, a donor will not end up having to pay any tax, due to various exceptions, deductions, and credits.

In order to help clarify issues related to the federal gift tax and contributions to nonprofits, Alliance for Justice is pleased to offer a new fact sheet outlining examples for when the federal gift tax may need to be considered.

NEW RESOURCE

The Time is Right for Leadership in Advocacy Funding

On Tuesday, May 5, 2009 Alliance for Justice and the Council on Foundations co-sponsored a session at COF’s 2009 conference, The Time Is Right for Leadership in Advocacy Funding. The discussion featured a panel of leading experts from the foundation community who have appeared in a collection of interviews co-published by Alliance for Justice and the Council on Foundations, Words to Give By: Leading Voices in Advocacy Funding. In addition to providing personal stories of the benefits of a strong commitment to advocacy funding, the panel emphasized the importance of community organizing, public policy advocacy and proper evaluation strategies in economically difficult times.

Advocacy Question of the week — March 6, 2009

We are a 501(c)(3) organization and while we are clear that we cannot support or oppose candidates we want to weigh in on the President’s nominee for a deputy secretary in the Treasury Department. Can we do this as a 501(c)(3) organization?
